Belgium

Flemish municipal coat of arms

This image depicts a coat of arms of a Flemish municipality or province. These coats of arms have been registered with the Flemish Heraldic Council (Vlaamse Heraldische Raad) [1].

The coat of arms belongs to the public domain of a city of municipality. Using it for advertising purposes, for example as a brand, is strictly forbidden.

Article 184 of the Belgian criminal law states that abuse of or forging a coat of arms can be punished with imprisonment between three months to three years. Attempting to create a coat of arms of misuse of it, is punished with imprisonment between one month and one year.

Using the coat of arms by private persons, private institutions or associations is only allowed if the council of the municipality or city has officially given permission for this. See e.g. [2].

In view of Flemish legislation this image is seen as being in the public domain, as are reproductions of this coat of arms.

According to Articles 39 to 44 of the Copyright Act of the Republic of Korea, under the jurisdiction of the Government of the Republic of Korea all copyrighted works enter the public domain 70 years after the death of the creator (there being multiple creators, the creator who dies last) or 70 years after publication when made public in the name of an organization. (30 years for death before 1957, 50 years before July 2013)

This applies to copyrighted works of which authors died before 1 January 1963, or made public in the name of an organization before 1 January 1963.

Furthermore, with the exceptions of photographs reproducing otherwise copyrighted works of art, and photographs inserted into a work of study or art and produced only for the purpose of inclusion within said work, photographs or other works of a similar form to photography either published or produced in negative on or before 31 December 1976 are now in the public domain in the Republic of Korea as their term of copyright has expired there.

There are exceptional cases. Property rights are to belong to the state according to provisions of the Civil Law and other laws upon the death of a copyright owner without heir or, in the case of a legal person or organization, upon its dissolution. The product must also be in the public domain in the United States.

  • Other works of public or private enties before 31 December 1967 through work-for-hire or express advertisement for claim as owners, even if these were collective works. For media no published in other Andean Community countries, the expiration is extended to 31 December 1970. In the case of journalistic works, the rights pass to the company if it did not identify the actual author of the editorial. In the case of film works prior to the date, the owner apply to the producer of the material and exclude the soundtrack, script or participation outside of the production staff.

It is understood that the work was disseminated to the public or via newspaper or broadcasting media and that its author is explicitly an entity. Therefore, after its first publication from 1 January of the following year, it expired before 1 January 1996 and was not renewed on the URAA date (1 January 1996). More information in COM:Peru.
  Warning: The Peruvian copyright law of 23 April 1996 repealed law 13714, in its transitory provisions it indicates that only "[the works still] protected in accordance with the previous law, will enjoy the most extensive terms of protection recognized in this Law" and denies retroactive effect.
