Foto do avião.

Tirei esta foto nas proximidades da avenida Santo Amaro, mais precisamente numa praça que se situa a frente de um grande ponto de parada de ônibus. Página de boas-vindas

FML, vi que você moveu a página de boas-vindas que estava sob o título "Bemvindo" para "Bem vindo". Só que há ainda uma pequena falha: o correto é Bem-vindo, com hífen a separar as duas palavras. Olá, Lipe! :-) Tudo bem? A questão com o Orgullo foi a seguinte: coloquei esta imagem Image:Antologio_de_brazilaj_rakontoj.jpg no commons. Porém, como não marquei licença (quer dizer, marquei, mas depois editei e a licença "saiu"), veio o bot do Orgullo (ele me respondeu! :-)) e marcou a imagem para ser deletada, como vc pode ver clicando no link da imagem. Acontece duas coisas: eu realmente não sei como classificar a licença e nem sei como fazer voltar a licença lá no "ficheiro". A imagem é uma capa de um livro raro de esperanto (1953). Que eu saiba, toda imagem de capa de livro pode ser usada como divulgação, logo poderia ser usada numa revista tanto quanto poderia ser usada numa enciclopédia. Como especificar isso, então? Eu pensei em "copyrighted, mas pode ser usado etc. e tal". Só que essa opção da parte de "license" lá na hora de carregar a imagem escracha de mais. Por isso, mudei prum ingênuo divulgação e veio o botzinhod do Orgullo. =P Ainda tô aprendendo sobre as frescurinhas do commons, então escorreguei nessa. Sobre a parte de "destruir": estou iniciando esforços para digitalizar facsimiles de certas obras de um autor em domínio público que por enquanto (e até meu cartão de crédito poder respirar aliviado, acredito que ele precise de uns 45 dias de UTI) não vou entrar em maiores detalhes, mas já adianto que necessitará de esforços conjuntos de editores da pt.wikipedia, pt.wikisource e Commons para usufruir de todo o acervo (que possui algum texto e muitas, muitas imagens mesmo). Já vá treinando como fazer crop de imagens (já que são várias por página) para quando eu postar o convite na Esplanada da Wikipédia.

Sobre as imagens do jogo da vida: FML, quando eu pedi para que lesse atentamente aquelas páginas já imaginava que ao me ver respondendo algo relativo a alguma coisa que você deseja mas não tem acesso de fazer iria ficar nervoso. Mas mesmo assim preferi responder. É sempre melhor algum lusófono que entende melhor o que a pessoa quis dizer em um inglês um pouco mais péssimo do que o seu tentar se comunicar do que deixar para alguém que vá tentar adivinhar pelo sentido de sinônimos usados o que a pessoa quer (aconselho para de dar tanto uso aos cognatos).

Finalmente, sem os ataques pessoais, vamos à resposta do que importa: FML, será que você leu aquelas duas páginas? Será que você se lembra que eu mesmo, em 2005 (ou 2006, não lembro agora) tinha dito a usuários sobre a questão de fotografar coisas em 3D para produzir alternativas livres era algo válido? Pois é, depois refletindo e acompanhando à distância algumas discussões de outras wikis eu me corrigi. Isso não era válido. Que diferença tem de eu escanear um livro protegido por direitos autorais e colocar a imagem como eu escaneei, o copyright é meu e eu libero todos os direitos de fotocopiar um livro dizendo o mesmo (sobre essas duas parte eu nunca tive dúvidas sobre o copyright)? E que diferença tem de eu fotografar um objeto falando isso? Nenhuma! Pare dois minutos a leitura e dê uma refletida.

A foto 3D de um objeto ou a foto de um objeto como parte de um cenário para se produzir algo livre, no entanto, pode ser aceita, mas preste muita atenção nisto: não para ilustrar o próprio objeto em algum lugar. Uma cena que tenha perdida em seu meio uma embalagem do MC'Donalds (para citar seu exemplo de defesa) e que esteja ilustrando pessoas assistindo algum evento é algo aceitável, a embalagem lá está, apenas perdida no meio do cenário. Mas se eu colocar essa mesma imagem (ou uma derivada dela) para ilustrar exatamente o produto daquela embalagem eu vou estar fazendo algo inadequado: eu vou estar usando diretamente o copyright de tal peça, ela não é mais um ponto no cenário, ela é meu foco. E utilizar o copyright de uma peça sem a sua devida autorização é, como você sabe, algo ilegal.

Por favor, esqueça a cena de a Wikimedia será processada. Isso é o de menos. Não que não seja uma preocupação a se ter, mas pare de imaginar que todos os que se esforçam em encontrar algo que tenha copyright e o eliminar das wikis seja por medo de processo. A preocupação aqui é em mapear exatamente o que se pode ser utilizado dentro da Wikimedia e fora dela. O que a Wikimedia é, na atualidade? Uma fundação responsável pelo décimo site mais acessado do mundo (a en.wikipedia) e por centenas de outros que também são bastante acessados, em dezenas de idiomas. E o que isso tem de mais? Pare para pensar um pouco na visibilidade que as licenças de conteúdo livre têm com tais sites e cogite melhor a possibilidade de usar a influência que eles possuem ao invés de usar a nossa birra mútua em certos assuntos para ter com quem brigar, por favor.

Apenas para encerrar: a arquitetura externa de certos objetos (carros, impressoras etc) é algo trivial e a questão de fotos em 3D é plenamente aceite. Mas e para objetos que o seu layout externo seja o essencial, e que tal layout externo seja mais único? (sinceramente, impressoras e carros de várias marcas costumam sempre ter um aspecto parecido se forem comparados modelos equivalentes; isso já não costuma acontecer com jogos, onde alguém inventou uma forma totalmente nova de lazer e aliou à ela um layout que também faz parte do mesmo).

Por favor, se esqueça de que sou eu que te escreveu essa resposta. Imagine como sendo outra pessoa. Não me responda imediatamente após ter lido a mensagem. Faça alguma outra coisa e responda depois. Eu não estou de intriga com ninguém neste assunto, estou apenas cumprindo meu papel de ajudar, dentro dos meus limites, na administração do Wikimedia Commons, que engloba uma base de usuários e uma base de conteúdos.
