Public domain This work is in the public domain in the United States and the source country. In most cases, this means that its copyright expired under the law of the source country and it was either published prior to January 1, 1927 or its copyright also expired under the law of the United States. This is a faithful photographic reproduction of a two-dimensional, public domain work of art. The work of art itself is in the public domain for the following reason:

The official position taken by the Wikimedia Foundation is that "faithful reproductions of two-dimensional public domain works of art are public domain".
This photographic reproduction is therefore also considered to be in the public domain in the United States. In other jurisdictions, re-use of this content may be restricted; see Reuse of PD-Art photographs for details.

Template:PD-scan

The original itself is in the public domain for the following reason:

This tag is designed for use where there may be a need to assert that any enhancements (eg brightness, contrast, colour-matching, sharpening) are in themselves insufficiently creative to generate a new copyright. It can be used where it is unknown whether any enhancements have been made, as well as when the enhancements are clear but insufficient. For known raw unenhanced scans you can use an appropriate {{PD-old}} tag instead. For usage, see Commons:When to use the PD-scan tag.

Dialog-warning.svg
Note: This tag applies to scans and photocopies only. For photographs of public domain originals taken from afar, {{PD-Art}} may be applicable. See Commons:When to use the PD-Art tag.

Note that "photographic works", which must display artistic merit or originality, enter the public domain 70 years after the death of the photographer and that photographs that are not considered works but created 1 January 1970 or later become public domain 50 years after they were created. See Licensing for details.

Some countries have a lower threshold of originality and may therefore apply a longer protection term for this image, so it may not be usable in such countries.

To uploader: For this to be applicable, creation year must be known (or known to be at least before 1970)
Note: in addition to this statement, there must be a statement on this page explaining why the photograph is public domain in the United States. (For example {{PD-1996}} or other relevant template)

Public domain This image is in the public domain because the Finnish Copyright law of 2005 specifies that all ”works of art” become public domain 70 years after the death of the creator, or 70 years after the date of publication of an anonymous work if the identity of the author was never disclosed within 70 years from publication.

Note: Photographs which are not considered to be works of art and are created before January 1, 1966 are in the public domain (§49a). See {{PD-Finland50}} for details. This template claims only that the image is public domain in Finland. An additional template should be included to explain why the image is public domain in the United States.

Public domain
This photograph is in the public domain in Finland, because either a period of 50 years has elapsed from the year of creation or the photograph was first published before 1966. The section 49a of the Finnish Copyright Act (404/1961, amended 607/2015) specifies that photographs not considered to be "works of art" become public domain 50 years after they were created. The 50 years from creation protection period came into force in 1991. Before that the protection period was 25 years from the year of first publication according to the §16 of the law of protection of photographs of 1961. Material already released to public domain according to the 1961 law remains in public domain, and therefore all photographs (but not photographic works of art) released before 1966 are in the public domain. See Commons:Copyright rules by territory/Finland for details.

If you think this picture should be considered a work of art, nominate it for deletion.
To uploader: Please provide where the image was first published and who created it.

This postage stamp published by Posti- ja telelaitos before January 1, 1990 is in the public domain in Finland because it is a part of a decision issued by a public authority in Finland. Section 9 of the Finnish Copyright Act specifies that no copyright exists in such material. (Link to the Act)

This template does not apply to postage stamps first published after 1989. Because Posti- ja telelaitos was changed from an authority to a company in the beginning of 1990, postage stamps published by Posti- ja telelaitos were not anymore part of decisions by an authority. Most probably the copyright owner of postage stamps published after 1989 are Itella Oyj or the designer of them. All postage stamps first published after 1989 marked with this tag should be speedily deleted.

This file is now in the public domain in the Republic of Korea (South Korea) because its term of copyright has expired there. (details)

According to Articles 39 to 44 of the Copyright Act of the Republic of Korea, under the jurisdiction of the Government of the Republic of Korea all copyrighted works enter the public domain 70 years after the death of the creator (there being multiple creators, the creator who dies last) or 70 years after publication when made public in the name of an organization. (30 years for death before 1957, 50 years before July 2013)

This applies to copyrighted works of which authors died before 1 January 1963, or made public in the name of an organization before 1 January 1963.

There are exceptional cases. Property rights are to belong to the state according to provisions of the Civil Law and other laws upon the death of a copyright owner without heir or, in the case of a legal person or organization, upon its dissolution. The product must also be in the public domain in the United States.

Public domain According to the law 13714 (1961), under the administration of the government of Manuel Prado and was not renewed on the URAA date, the work is public domain in Perú because are met the following criteria:
  • The author was not covered under the 1961 law because this author died before 1931 regardless of whether their works are public or no. For example, manuscripts by Miguel Grau.
  • The author was protected under the 1961 law, the work was published or registered in the National Registry of Copyrights before 1966 and:
    • The author died between 1931 and 1945 with family heirs.
    • The author died between 1945 and 1965 without family heirs (parents, spouses and children) under assignee(s).

In the case of collective works, the term from the death of the last author is considered. In conjugal works, its "moral rights" are considered. More information and examples in COM:Peru.
Dialog-warning.svg Warning: The vigent Peruvian copyright law of 23 April 1996 repealed law 13714 and in its transitory provisions indicates that only "[the works still] protected in accordance with the previous law, will enjoy the most extensive terms of protection recognized in this Law" and denies retroactive effect. Public domain According to the law 13714 (1961) under the administration of the government of Manuel Prado, and article 4.3 of the Universal Copyright Convention, the work of public entity (in spanish: persona júridica) is public domain in Perú because are met the following criteria:
  • Any work created and/or assigned to the Peruvian State and published before December 31, 1970. It was protected for 25 years and immediately assigned to the public domain. In the case of official documents of the Executive Branch, Legislative Branch and Judicial Branch, it extends to May 23, 1996.
  • Works considered of "public utility" by the Ministry of Public Education of an author who: (a) died before 20 August 1988 (b) had no copyright notice or claim by his/her heirs (c) is an orphan after the liquidation of his/her publishing house before the entry of the Berne Convention in 1988.
  • Other works of public or private enties before 31 December 1967 through work-for-hire or express advertisement for claim as owners, even if these were collective works. For media no published in other Andean Community countries, the expiration is extended to 31 December 1970. In the case of journalistic works, the rights pass to the company if it did not identify the actual author of the editorial. In the case of film works prior to the date, the owner apply to the producer of the material and exclude the soundtrack, script or participation outside of the production staff.

It is understood that the work was disseminated to the public or via newspaper or broadcasting media and that its author is explicitly an entity. Therefore, after its first publication from 1 January of the following year, it expired before 1 January 1996 and was not renewed on the URAA date (1 January 1996). More information in COM:Peru.
Dialog-warning.svg Warning: The Peruvian copyright law of 23 April 1996 repealed law 13714, in its transitory provisions it indicates that only "[the works still] protected in accordance with the previous law, will enjoy the most extensive terms of protection recognized in this Law" and denies retroactive effect.

Public domain

This photograph was in the public domain in Switzerland before April 1, 2020, as it has no individual character. According to applicable case law, the individual expression of thought required for protection was present if the photograph was given an individual character e.g. by the choice of framing, the use of camera settings or the editing of the image. Conversely, it was not present, irrespective of the object and the setting, if the image was a mere "point-and-click" image with no individual characteristics. See Blau Guggenheim v.
